TERMS AND LICENCE RESPONCIBILITIES
1. LICENCE AVAILABILITY
This licence is available to persons or organizations that conduct religious worship services on designated premises ie, a church school or religious group or institution, to cover worship services conducted by their members. It is not available to Diocese's or groups of churches, religious congregations or national organizations unless it is for their own use only. Groups or umbrella organizations cannot take out a licence on behalf of a number of individual churches, schools or religious communities who are conducting religious worship in a number of locations. This licence is only intended for a specific church, school, community, etc. Note that Churches can take out an extended licence which covers church related groups utilizing copied material within the precincts of the parish. This licence is designed to cover prayer groups, home worship etc, within the parish. It does not cover separate organizations such as schools, convents etc using copied material on their own premises. However, if a school is built on the same premises as the church and the school is owned by the church, then the school can be covered by a "Whole of Parish/Extended" copyright licence held by the church.
2. COPYING REQUIREMENTS
The licence is restricted to making copies for congregational use only, to be used by the licenced body. Reprinting may take the form of typewritten words that are duplicated mechanically, or reproductions from published music editions. No guitar chords, choir parts (harmony) or any other type of accompaniment pages may be reproduced or handwritten. These parts must be deleted from the master. The reprinting of the melody line only is permitted. This licence enables the coping of music lyrics on paper, slides, transparencies, overhead and computer projection. The full title, composer, & publisher name must be listed with each hymn. The following copyright notice must appear directly beneath each song-Used With Permission, Word Of Life International- Licence No..... Copies can only be made from original works not previously photocopied reproductions. The licence holder must own at least one original published edition of the work copied. Copying from originals not owned by the licence holder is not permitted.3. TERM
Annual Restricted Copy Licence Applies for one year (12 calendar months) commencing on the date of acceptance of the licence application by WORD OF LIFE INTERNATIONAL, and the allocation of a licence number. It shall continue thereafter for annual periods, until terminated by either party by giving the other 3 months written notice so as to expire on the same day and month of the initial period. Upon termination, all copies made under the licence must be destroyed.
One Time Use Licence
This licence is for any number of titles covered by the agreement. It is for one occasion, this occasion may extend over 7 days in one location.
4.PAYMENT DEFAULT
Payment in full is required before the granting of any licence. In the case of annual licences, should a license not be paid by the date of expiry, interest will accrue at the rate of 14% per annum.
5. COPYING REQUIREMENTS FOR ANNUAL MUSIC COPY LICENCE
These Licences are completely separeate from and do not replace the Annual Restricted Copy Licence. They grant the right to copy music only for choirs and musicians ie. Full score music, guitar chords, choral harmonies etc. The copies made under this licence are not to be projected in way or form for congregational us. The Title, Composer and Publisher must be listed with each hymn reproduced. The following copyright notice must be appear directly beneath each page of music copied - "Used with permission, Word of Life International Licence number ............ These copies can only be made providing 2 copies of the music is owned by the licence holder.
6. SPECIFIC CONDITIONS FOR EACH LICENCE
Annual Restricted Licence Conditions
Word Of Life International agrees to provide a list of the most popular titles covered by the licence at the commencement of the licence period, and then annual updates with new titles included. Plus a list of publishers or individual composers represented.The Licence holder agrees to provide, at the end of each licence period, the details of the works copied during the period on the form provided (Statistical Survey) or on the computer disk provided.
One Time use Licence
This licence is not restricted in terms of the number of songs it covers (except that it is only granted to cover those titles which are controlled by the Publishers/composers represented by WOL) All copies made under the licence must be retained by individual participants, and as far as is humanly possible, collected and destroyed at the conclusion of the occasion(except for those copies retained by the participants in memory of the occasion ). Requests for permission for One Time Use Licences should not exceed a maximum of 6 per annum from any church or organization. (An Annual Restricted Copy Licence is required for more frequent use).
Parish Hymnal licence
Permission is granted only for the physical life of the book. Any additions or reprints require new permission and the payment of a processing fee. All hymnals can only be used by the licence holder and it's members.
7. USE OF COPIED MATERIAL
All licences are granted for private use only. The material copied cannot be sold or loaned to other organizations or individuals.
8. PROVISION OF ACCOMPANYING DATA IN RELATION TO THE LICENCE
A copy of the hymnal or copies made or transcribed under any of the licences, is to be provided on request.
9. TITLES COVERED
This licence is granted to cover titles listed in the Song Title Listing/computer disk, plus any other titles controlled by the publishers/composers represented by Word Of Life International. IT DOES NOT INCLUDE ANY WORKS THAT ARE NOT CONTROLLED OR OWNED BY THESE PUBLISHERS & COMPOSERS.10. MEMBER BODIES
Means those publishers or individuals on whose behalf Word Of Life International is acting as collecting Agent.
11. INDEMNITY
Word Of Life International agrees to indemnify license holders against any claim, action or demand by it's members for breach of copyright, provided the license holder is acting in accordance with all the above license conditions.
12. PUBLIC RELIGIOUS WORSHIP
Means a gathering of people for the purpose of taking part in a formalized service of worship. ACT means the Australian Copyright Act 1968. USUAL RELIGIOUS WORSHIP MEETINGS refers to all forms of liturgical celebrations, either as special events or regularly planned worship.
13. ORGANISATIONS NOT CHURCHES OR SCHOOLS
This licence may be applied to "Traveling Ministries", "Christian Outreach Teams", Retreat Houses" or "Camps" and other places where public worship is held.
